Tyrol is a heavyweight in the tourism industry. Every year, the transnational alpine region attracts people from all over the world. It is obvious that due to enormous demand, real estate is continuously increasing in value. Added to this are the topographical conditions, which in some places make the construction of new buildings difficult or impossible. A holiday property has to be rented to constantly changing guests, especially since the creation of leisure residences is prohibited according to the Tyrolean Spatial Planning Act and possibly according to private spatial planning contracts. There is therefore a rental obligation. The holiday property is rented out by a commissioned operator for the owner.

A property management company is commissioned to manage the entire property. The operating company handles the rental to tourists.

The purchaser acquires ownership of the respective apartment and the car parking space or parking spaces.

Apartment ownership is the right in rem granted to the respective co-owner of a property to exclusively use and dispose of an independent apartment, other independent space or a car parking space. The general areas of the property, such as the wellness area, the technical systems, the ski room, etc. are for the use of all co-owners and are in undivided co-ownership.

At least one parking space must be purchased together with an apartment. If additional parking spaces are available, the purchaser is free to purchase additional parking spaces.

Each apartment has an internet connection and Wi-Fi. There are TV connections in the living area as well as in the bedrooms of the apartments.

The acquisition of the property does not result in the acquisition of shares in an operating company.

The property developer is the owner and therefore the seller of the property. The property development company only involves Tirol Real Estate for marketing the property and advising the buyer.

In addition to natural persons, companies or legal entities can also purchase apartments and parking spaces.

In accordance with the Property Developer Contract Act, a lawyer who is commissioned by both contracting parties and appointed as a trustee draws up the purchase contract and handles the legal transaction.

  • Real estate transfer tax: 3.5% - the gross purchase price plus 50% of the gross contract establishment costs are used as the basis for assessment
  • Entry fee for the land register: 1.1% of the gross purchase price
  • Brokerage fee of 3% of the net purchase price plus 20% VAT
  • Costs for any annotations in the land register as stipulated
  • Notary certification costs as per prescription
  • the costs and fees associated with the incorporation of a lien as stipulated (entry fee in the land register – 1.2% of the amount to be entered)

The property development company informs the buyer of the date of the handover of the apartment. A defect report will be drawn up upon handover. All reported defects will be remedied within a reasonable period of time. In addition, upon payment of the last purchase price installment, the buyer will be given a bank guarantee in the amount of 2% of the purchase price with a term of three years from handover of the object of purchase in the event that the property development company fails to meet this obligation.

The apartments are - as we affectionately call them - handed over "SPOOZE READY". In addition to all the furniture, glasses, crockery and cutlery are also available in the apartment upon handover.

The operator takes care of the proper and rental-friendly equipment in consultation with the property development company, so that the rental can start as soon as the apartments are handed over.
